Welcome to PDForbit. These Terms of Service ("Terms") govern your use of pdforbit.net and the tools we provide (the "Service"). By using PDForbit, you agree to these Terms. If you do not agree, please do not use the Service.
1. Use of the Service
PDForbit provides browser-accessible tools for working with PDF and image files, including merging, splitting, compressing, converting, rotating, watermarking, and protecting documents.
You agree to use PDForbit only for lawful purposes. You may not:
- Upload or process files that you do not have the legal right to use, copy, or modify
- Use the Service to process content that is illegal, infringing, fraudulent, or harmful
- Attempt to disrupt, overload, or interfere with the Service's infrastructure
- Attempt to reverse-engineer, scrape, or misuse the Service beyond normal, intended use
- Use automated systems to abuse or overload our tools without our prior written permission
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use PDForbit. By using the Service, you confirm that you meet this requirement.
3. Your Files and Content
You retain all ownership and rights to any files you upload or process using PDForbit. We do not claim any ownership over your content.
You are solely responsible for ensuring you have the right to upload, process, and use any file through our Service. We do not monitor file content and are not responsible for how you use the tools or the output they produce.
Please refer to our Privacy Policy for details on how files are processed and, where applicable, temporarily stored.
4. Copyright Complaints (DMCA and Equivalent)
PDForbit is a tool for processing files you already have the rights to - we do not host, index, or distribute user files as content, and files are deleted shortly after processing (see our Privacy Policy). If you nonetheless believe that content processed or displayed through the Service infringes your copyright, contact us at hello@pdforbit.net with:
- A description of the copyrighted work you believe is infringed
- The specific material or URL you believe is infringing
- Your contact information
- A statement that you have a good-faith belief the use is unauthorized
- A statement, under penalty of perjury, that the above information is accurate and that you are authorized to act on behalf of the copyright owner
We will review and respond to valid notices in accordance with applicable law.
5. No Warranty
PDForbit is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do our best to ensure tools work accurately and reliably, but we do not guarantee that:
- The Service will be uninterrupted, error-free, or secure at all times
- Converted, compressed, or processed files will be free of defects
- The Service will meet your specific requirements
We strongly recommend keeping backup copies of your original files before processing them.
6. Limitation of Liability
To the fullest extent permitted by law, PDForbit and its operators shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, revenue, profits, or business opportunities, arising from your use of, or inability to use, the Service - even if we have been advised of the possibility of such damages, and even if a remedy fails of its essential purpose.
To the extent any liability cannot be excluded under applicable law, our total aggregate liability to you for any claim arising from or related to the Service is limited to the greater of (a) the amount you paid us to use the Service in the 12 months before the claim arose, or (b) USD $50.
Your sole remedy for dissatisfaction with the Service is to stop using it.
7. Indemnification
You agree to defend, indemnify, and hold harmless PDForbit and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) any file you upload or process through the Service, (c) your violation of these Terms, or (d) your violation of any third party's rights, including intellectual property or privacy rights.
8. Service Availability and Changes
We may add, modify, suspend, or discontinue any tool or feature of PDForbit at any time, with or without notice. We are not liable for any impact this may have on your use of the Service.
9. Intellectual Property
The PDForbit name, logo, design, and underlying software are the property of PDForbit and may not be copied, reproduced, or used without our prior written permission. This does not apply to the files you process through the Service, which remain yours.
10. Third-Party Links and Services
The Service may link to or rely on third-party websites, tools, or infrastructure providers. We do not control and are not responsible for the content, policies, or practices of any third party. Use of third-party services is at your own risk and subject to their own terms.
11. Termination
We reserve the right to restrict or block access to the Service for anyone who violates these Terms or uses the Service in a way that could harm PDForbit, its infrastructure, or other users, without prior notice.
12. Dispute Resolution
If a dispute arises, we encourage you to first contact us at hello@pdforbit.net so we can try to resolve it informally. If a dispute cannot be resolved informally within 30 days, either party may pursue the dispute through the courts or arbitration forums available under the governing law referenced below.
13. Governing Law
These Terms are governed by applicable law without regard to conflict-of-law principles. Any disputes arising from these Terms or use of the Service will be handled in accordance with applicable local regulations.
14. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PDForbit regarding use of the Service, and supersede any prior agreements.
15. Changes to These Terms
We may revise these Terms from time to time. We'll update the "Last updated" date above whenever changes are made. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
